Open Letter:
Resisting the EHRC Code of Practice in Oxford
Dear Irene Tracey and the Oxford University community
We, as staff and students of Oxford University, call upon you to support your trans, non-binary, intersex and gender non-conforming peers and colleagues.
In response to the updated Equality and Human Rights Commission's (EHRC) Code of Practice, Oxford University updated their ‘Toilets and changing facilities’ information on the staff intranet. It includes the following guidance:
We, as staff and students of Oxford University, call upon you to support your trans, non-binary, intersex and gender non-conforming peers and colleagues.
In response to the updated Equality and Human Rights Commission's (EHRC) Code of Practice, Oxford University updated their ‘Toilets and changing facilities’ information on the staff intranet. It includes the following guidance:
Under the Services Code, where toilets and changing facilities are single-sex these must be provided on the basis of ‘biological sex’ (sex registered at birth). The University’s single-sex toilets and changing facilities are provided on this basis.
The Code of Practice is an affront to the safety and dignity of trans+ people, both in the exclusionary policies and their notoriously unclear enforceability. The EHRC themselves admit “there is no type of official record or document in the UK which provides reliable evidence of sex” (13.179) and that, even though “it is not always possible to be sure of a person’s sex from their appearance”, “the individual’s physique or physical appearance, behaviour or concerns raised by other service users” could be used to assess sex (13.168). The Code is unfit for purpose. Its invasive, transvestigative approach to enforcement puts service users at risk in the moment and creates legal risk for all involved.
Despite – and to some extent because of – its practical unenforceability, the Code still normalises transphobia. It creates a hostile environment in which more people will be afraid to use their preferred facilities and transphobes are emboldened. We can and must work to mitigate these harms by making each other feel safer and demonstrating that transphobia is not normal.
We understand that the University, alongside service providers around the country, is under immense pressure to adopt the EHRC’s transphobic interpretation of the law. However, this is not an excuse to passively accept transphobia in our places of work, study, and accommodation. There is an opportunity to set an example of the kind of resistance that is possible with its money, prestige, and power. The University could:

We can, however, rely on each other to keep us safe. “The University” exists as an institution, but it also exists in the collective of students and staff who live, work, and study here. - build upon the current policy of including gender neutral facilities in new buildings and renovations by ensuring they are readily available in all existing university buildings.
But we know we cannot rely on asking institutions to keep us safe. And as that collective – as the people who use Oxford’s spaces – we can resist the EHRC Code and our institution’s acceptance of it by:
- continuing to use the bathrooms that align with our gender;
- showing visible support for trans+ inclusion;
- challenging harassment when it happens;
- refusing to participate in policing other people’s gender/sex.
The Code is only as enforceable as we, as a collective, allow it to be.
